Schoonover, pursuant to K.S.A. 60-1507 to set aside a conviction and sentence of life imprisonment for murder in the first degree imposed after trial by jury. The factual circumstances surrounding the homicide are not set forth with particularity in either the record or briefs of counsel. Suffice it to say Mrs. Schoonover was charged with the premeditated murder of her husband, J.W. Schoonover, on October 24, 1973, in Franklin county. The petitioner does not contend that the evidence presented at the trial was insufficient to sustain the verdict of the jury. [218 Kan. 378]
